Getting arrested for a DUI is not only traumatic, it will result in TWO separate cases filed against you: 1.
) A Criminal Complaint filed by the District Attorney in Superior Court (as either a misdemeanor or a felony, depending on whether or not injuries are involved) alleging that you were driving under the influence and/or with a .
08 percent (or greater) blood alcohol, AND 2.
) A separate DMV "Order of Suspension" of your Drivers License for driving with .
08 percent (or greater) blood alcohol.
You need to do several things IMMEDIATELY to start damage control: With regard to the DMV "Order of Suspension" of your drivers license, a request must be made with the DMV Drivers Safety Office for a Hearing WITHIN TEN (10) ACTUAL DAYS of your arrest, or else you will have waived your right to have a Hearing.
There is a telephone number to call DMV on your pink "Temporary Drivers License" given to you by the arresting officer.
If you retain me as your attorney, I can make the call for you to the DMV to request a hearing, but ONLY IF it is within the ten day period after your arrest.
Regarding the criminal case against you, a detailed examination of the facts leading to your arrest should be done as soon as possible.
Review of the Arrest Report (and Accident Report if there was an accident) should be done as soon as these documents are available.
Arrangements should be made with the District Attorney's Office for a privately-made retest of your blood sample (if that is the test you chose), or a review of the maintenance records of breath machine and the qualifications of the officer conducting the test (if you elected this test).
Finally, witnesses (if any) should be questioned and comparisons made with the alleged statements in the Arrest Report.
